On September 23, 2010, a complete monitoring system certification test report from the <br />July 20, 2010, testing was submitted (Attachment 11). <br />On September 28, 2010, Mr. Backus received a telephone call from Mr. David Miraflor, a <br />consultant for Mr. Tiwana. Mr. Miraflor said he will try to keep the UST monitoring <br />system active by using a portable power generator. Mr. Backus explained to Mr. Miraflor <br />that the UST system must be placed into temporary closure if power to the UST <br />monitoring system cannot be maintained. Mr. Backus described the UST temporary <br />closure process and the EHD permit requirement to Mr. Miraflor. Mr. Backus suggested <br />that Mr. Miraflor notify the San Joaquin Valley Air Pollution Control District regarding this <br />construction project. <br />On October 7, 2010, Mr. Backus visited the facility to survey the construction being done <br />(Attachment 12). A trench had been dug through the path of the UST vent lines. The <br />vent lines appeared to be intact. The west wall of facility building was removed. The <br />UST monitoring panel was on and the warning light was blinking. <br />On October 8, 2010, Mr. Backus met Mr. Tiwana at the facility. Mr. Backus verified that <br />the monitoring panel light was blinking due to low fuel levels in tank 1. A construction <br />crew was breaking concrete and trenching over the gasoline and diesel product lines <br />(Attachment 13). Mr. Backus told Mr. Tiwana that secondary containment testing of the <br />product piping under permit and inspection of the EHD would be required before the <br />facility reopens. <br />On October 11, 2010, Mr. Backus left a voicemail for Mr. Tiwana asking him to apply for <br />a permit to test the secondary containment piping. <br />On October 11, 2010, Mr. Backus visited the facility and met Mr. Miraflor on site, who <br />stated that a power generator would be connected to the monitoring panel to retain <br />power. Mr. Backus verified that the UST monitoring panel was operating with no alarms <br />and explained to Mr. Miraflor that Mr. Tiwana has to obtain a permit to test the <br />secondary containment piping. A photo was taken of the trench crossing the product <br />piping (Attachment 14). <br />On October 14, 2010, a permit application, SR0061248, was submitted to install a water <br />line that crosses the UST product piping (requiring secondary containment testing). Mr. <br />Backus approved the permit application on October 18, 2010 (Attachment 15). <br />On October 25, 2010, Mr. Backus received a call from Mr. Miraflor, who stated that <br />Pacific Gas and Electric needed to terminate power to the facility to do work. Mr. <br />Backus explained that continuous monitoring must be maintained on the USTs or be <br />temporarily closed. <br />On November 10, 2010, Mr. Backus visited the facility and observed that the UST <br />monitoring panel was not powered on. A power generator was on site but was not <br />operating. <br />On November 12, 2010, Mr. Backus called Mr. Tiwana and explained that the UST <br />monitoring panel was not operational on November 10, 2010.
