The underground tank system shall be <br />designed and constructed with a monitoring system capable of detecting the entry of the <br />hazardous substance stored in the primary containment into the secondary containment <br />4 A float and chain device used to stop the flow of fuel to the dispenser when a <br />leak is detected failed when tested on August 11, 2009. <br />HSC 25291(f) Annual line leak detector test not performed. Underground <br />pressurized piping that conveys a hazardous substance shall be equipped with an <br />automatic line leak detector and shall be tightness tested annually. <br />4 Annual leak detector testing was due by June 2009 and was performed on <br />August 11, 2009, one month late. <br />HSC 25292.2 Current financial responsibility documents not on file with the EHD. <br />(a) All owners and operators of an underground tank system shall maintain evidence of <br />financial responsibility for taking corrective action and for compensating third parties <br />for bodily injury and property damage caused by a release from the underground <br />tank system, in accordance with regulations adopted by the board pursuant to <br />Section 25299.3. The regulations shall include a schedule that requires that financial <br />responsibility requirements are phased -in for all underground storage tank systems <br />on or before October 26, 1990. <br />(b) If the owner and the operator are separate persons, either the owner or the operator <br />shall demonstrate compliance with subdivision (a). <br />(c) An owner may comply with this article by entering into an agreement with the <br />operator of the tank requiring the operator to demonstrate compliance with <br />subdivision (a). However, both the owner and the operator are in violation of <br />subdivision (a) if evidence of financial responsibility is not established and <br />maintained in accordance with this article. <br />4 Current financial responsibility documents were not found on site during the <br />August 11, 2009, and July 20, 2010, routine UST inspections. <br />Title 23, CCR 2630(d) UST monitoring system is not installed or maintained to <br />detect a leak at the earliest opportunity. All monitoring equipment used to satisfy the <br />requirements of this article shall meet the requirements of section 2643(f) and shall be <br />installed and maintained such that the equipment is capable of detecting a leak at the <br />earliest possible opportunity. Additionally, all monitoring equipment used to satisfy the <br />requirements of this article shall be installed, calibrated, operated, and maintained in <br />accordance with section 2638. <br />4 The UST monitoring panel was shut off on or before November 10, 2010, and <br />the UST system has not been monitored since. <br />Title 23, 2632(b) Monitoring Plan (Monitoring and Response Plans) is not current <br />or approved by the EHD. Owners or operators of underground storage tanks subject to <br />this section shall implement a monitoring program approved by the local agency and <br />specified in the underground storage tank operating permit. The program shall include <br />interstitial space monitoring as described in subsection (c) and shall include the items <br />listed in subsection (d). <br />4 Monitoring and Response Plans were not current during the July 20, 2010, <br />routine UST inspection. <br />9 <br />
