I SALES/MINI-MART activities in the County of San Joaquin and elsewhere in the State of 2 California. 3 3. Defendants, in the course of defendant's GASOLINE SALES/MINI-MART activities, 4 are pursuant to Health and Safety Code, Chapter 6.7 hereby permanently enjoined from: 5 a. Operated gasoline pumps without a permit after January 1, 2003, in violation 6 of Health and Safety Code §25284(a)(1); 7 b. Failure to replace secondary containment system, in violation of 22CCR 8 §2637(a)(1). 9 C. Failure to perform Annual Monitoring Certification, in violation of 22CCR 10 §2637(b). 11 d. Failure to perform Annual Line Tightness Test; in violation of 22CCR 12 §2636(f)(4)• 13 4. Defendants, in the course of defendants' GASOLINE SALES/MINI-MART activities, 14 are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: 15 a. Violation of Chapter 6.7, of the Health and Safety Code described in 16 paragraph 3 above. 17 5. Defendants shall pay to plaintiff the sum of TEN THOUSAND DOLLARS 18 ($10,000.00), as and for civil penalties, 'pursuant to Business and Professions Code §§ 17200 et seq.. 19 Said payments shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and 20 delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions 21 Unit, ON OR BEFORE DECEMBER 1, 2004: 22 6. Defendants shall pay to plaintiff the sum of TEN THOUSAND DOLLARS ($10,000),' 23 as and for civil penalties, pursuant to Health and Safety Code §25299.'
