I <br />SALES/MINI-MART activities in the County of San Joaquin and elsewhere in the State of <br />2 <br />California. <br />3 <br />3. Defendants, in the course of defendant's GASOLINE SALES/MINI-MART activities, <br />4 <br />are pursuant to Health and Safety Code, Chapter 6.7 hereby permanently enjoined from: <br />5 <br />a. Operated gasoline pumps without a permit after January 1, 2003, in violation <br />6 <br />of Health and Safety Code §25284(a)(1); <br />7 <br />b. Failure to replace secondary containment system, in violation of 22CCR <br />8 <br />§2637(a)(1). <br />9 <br />C. Failure to perform Annual Monitoring Certification, in violation of 22CCR <br />10 <br />§2637(b). <br />11 <br />d. Failure to perform Annual Line Tightness Test; in violation of 22CCR <br />12 <br />§2636(f)(4)• <br />13 <br />4. Defendants, in the course of defendants' GASOLINE SALES/MINI-MART activities, <br />14 <br />are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br />15 <br />a. Violation of Chapter 6.7, of the Health and Safety Code described in <br />16 <br />paragraph 3 above. <br />17 <br />5. Defendants shall pay to plaintiff the sum of TEN THOUSAND DOLLARS <br />18 <br />($10,000.00), as and for civil penalties, 'pursuant to Business and Professions Code §§ 17200 et seq.. <br />19 <br />Said payments shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and <br />20 <br />delivered to the San Joaquin County Office of the District Attorney, Environmental Prosecutions <br />21 <br />Unit, ON OR BEFORE DECEMBER 1, 2004: <br />22 <br />6. Defendants shall pay to plaintiff the sum of TEN THOUSAND DOLLARS ($10,000),' <br />23 <br />as and for civil penalties, pursuant to Health and Safety Code §25299.' Said payment shall be made <br />24 <br />payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT - <br />25 <br />ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br />26 <br />Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, ON OR BEFORE <br />27 <br />SEPTEMBER 1, 2005. <br />28 <br />2. <br />
