The injunctive provisions of this Final Judgment are applicable to Defendants, its <br />subsidiaries and divisions, and any agent, employee, representative and all persons, corporations, or <br />other entities acting by, through, under, or on behalf of Defendants and all persons in concert with or <br />participating with said Defendants with actual or constructive knowledge of this injunction, only <br />insofar as they are doing business in the State of California and confined to Defendants' GASOLINE <br />SALES/MINI-MART activities in the County of San Joaquin and elsewhere in the State of California. <br />3. Defendants, in the course of Defendants' GASOLINE SALES/MINU-MART activities, are <br />pursuant to Health and Safety Code section 25100 et seq., hereby permanently enjoined from: <br />a. Failing to maintain and operate facility to minimize the possibility of a fire, <br />explosion, or any unplanned sudden or non -sudden release of hazardous waste, in violation of <br />California Code of Regulations, title 22 section 66265.31; <br />• • r • r. • i • • •rI - 1 ••1T •• <br />c. Failing to retain copies of signed manifest for at least three (3) years from the date <br />the waste was accepted by the initial transporter, in violation of California Code of Regulations, title <br />22 section 66262.40(a); <br />d. Failing to retain a copies of consolidated manifest for at least three (3) years, in <br />violation of Health and Safety Code section 25160.2(b)(3); <br />e. Failing to use a bill of lading to record the transfer of used oil filters, in violation of <br />California Code of Regulations, title 22 section 66266.130(c)(5); <br />f. Failing to train facility personnel in hazardous waste management procedures <br />relevant to the positions in which they are employed, in violation of California Code of Regulations, <br />title 22 section 66265.16; <br />W <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
