Main St. <br />Ripon, Ca 95366 <br />This is in response to your letter of August 1, 1996 that addressed the issue <br />of leak detector and probe replacement at your facility. In your letter you <br />requested information in regards to repair requirements and a copy of the more <br />restrictive regulations that the Environmental Health Division uses to require <br />permits for non -release type repairs. The Environmental Health Division (EHD) <br />gains authority to require permits for repairs through the Health and Safety <br />Code sections # 25286 (a) and 25299.2 (copies attached). The issue is also <br />addressed in CCR Title 23 section 2711 (a) & (b) (copies attached). The <br />Environmental Health Division has discussed the issue with the State water <br />Resources Control Board (SWRQB) and have received their concurrence on the <br />matter. The Environmental Health Division has recently developed a policy to <br />eliminate any confusion in the matter (copy attached). All repairs that are or <br />were made to the tank, below grade piping and monitoring system of an <br />underground storage tank system are required to be made under PHS-EHD permit. <br />The purpose for the permit is insure proper installation, function and state <br />requirements for installation (see LG 113-#). The annual certification of <br />equipment does not address all of the necessary issues listed above and will <br />not be accepted in lieu of the required PHS-EHD permit. Failure to obtain <br />required permits for work completed within 30 days of receipt of this letter <br />will result in further legal action. <br />IF you have any questions regarding this matter, please contact me at (209) <br />468-0332. <br />Ernest M.
