CALIFORNIA LECIsI.ATunl:-1991-92 nECULAR SESSION AB 1057 —2— <br />ASSEMBLY <br />2— <br />ASSEMBLY BILL No. 1057 <br />Introduced by Assembly Member Sher <br />C March 4, 1991 <br />An act to amend Section 25283.5 of the Health and Safety <br />Code, relating, to hazardous substances. <br />LEGISLA71VE COUNSEL'S DIGEST <br />AB 1057, as introduced, Sher. Underground storage tanks: <br />exemption. <br />Existing law generally regulates the storage of hazardous <br />substances in underground storage tanks. Existing law <br />exempts from these requirements a tank in the County of San <br />Diego which is located in an underground structure and <br />meets specified requirements. <br />This bill would delete the condition that the exempted tank <br />be located in the County of San Diego. <br />Vote: majority. Appropriation: no. Fiscal committee: yes. <br />State -mandated local program: no. <br />1 <br />2 <br />3 <br />4 <br />6 <br />7 <br />9 <br />10 <br />I i <br />The people of the State of California do enact as follows: <br />SEMOWL Section 25283.5 of the Health and Safety <br />Code is amended to read: <br />25283.5. An underground storage tank which meets <br />all of the following criteria is exempt from the <br />requirements of this chapter: <br />(a) All exteri:..r surfaces of the tank, including <br />connected piping, and the floor directly beneath the <br />tank, can be monitored by direct viewing. <br />(b) The structure in which the tank is located is <br />constructed in such a manner that the structure provides <br />-- secondary containment of the contents of the tank, as <br />99 90 <br />. <br />OA - 'kA;! slR:tiAtk�! .,.KrtYti �I'Oi.M�U�MR� <br />1 determined by the local agency designated pursuant to <br />2 Section 25283. <br />3 (c) The owner or operator of the underground storage <br />4 tank conducts daily inspections of the tank and maintains <br />5 a log of inspection results for review by the local agency, <br />6 designated pursuant to Section 25283, as requested by the <br />7 local agency. <br />8 (d) The local agency designated pursuant to Section _ <br />9 25283 determines without objection from the State <br />10 Water Regettrees Geni:rel Beard board that the <br />11 underground storage tank meets requirements which are <br />12 equal to or more stringent than those imposed by this <br />13 chapter. <br />14 JO The tmdergreund sterage tank is leented in a <br />15 eetmty of the 64rd elase; as deed in Seetien 28924 of the <br />16 Gemermnefft Gado: <br />X <br />., <br />+A �k !P9 100 <br />. <br />
