According to Title 23, California Code of Regulations, Section
2637 (b), this testing must be performed at least once every 12 months. According to section 2636
(f)(4), you must submit your pressurized line tightness test to this office annually [unless exempt
under section 2636 (f)(5)]. Schedule the required testing with a qualified technician by
immediately. Each and every day your system is out of compliance is a separate violation.
Additionally, secondary containment systems should have been tested by December 31, 2002 and
every thirty-six months thereafter. (Section 2637 (a). However, our records indicate that the diesel
line still has not been tested. Schedule this test immediately. Each and every day your system is
out of compliance is a separate violation.
Also, it had already been noted in last year's inspection report that all secondary containment,
including under -dispenser containment shall be equipped with a continuous monitoring system
(Section 2636(f)(1)). Obtain a permit from this office to retrofit the current system to satisfy
this requirement immediately. Each and every day your system is out of compliance is a
separate violation.
This office must be notified of the test date and time 48 hours prior to performing any of the above
tests. Results from the above testing must be sent to this office within 30 days of the test completion.
If you have any questions regarding this matter you may contact me at (209) 468-3459.
Thank you,
Dennis Catanya, Senior REHS
Registered Environmental Health Specialist
