The following describes the violations you noted during your inspection as well as corrective
actions taken:
107 - CCR 2632(d)(1)(C) Plot plan/site map not submitted or failed to completely show where
monitoring is performed. An accurate UST Monitoring Site Plan was not submitted. The
annular sensor on the site plan is not located at the correct location.
On 7/21/2017, BP Vendor, Belshire Environmental Services, Inc., modified the UST Monitoring
Site Plan to more accurately identify location of the annular sensors. The updated UST
Monitoring Site Plan was uploaded and submitted to CERS portal. A copy of the submittal is
enclosed herein for your review and records.
315 - HSC 25291(e) Water in secondary containment not removed, analyzed, and properly
disposed of(pre-Jul 2003). Liquid was observed in the 87 master fill sump.
On 7/20/2017, BP Testing and Maintenance Vendor, Gettler-Ryan, Inc., removed approximately
1 cup of liquid from the 87 master fill sump. This violation was corrected onsite as stated in
your inspection report. BP maintains that the liquid was due to condensation from
environmental conditions.
It is our policy to operate in full compliance with all laws and regulations at our retail facilities.
However, when we fall short of perfection, we endeavor to immediately address deficiencies, issues of
concern, and/or agency requests regarding our retail facilities. With the submittal of this letter, it is our
understanding that the item(s) of alleged non-compliance have been resolved and no further corrective
action is required. Furthermore, we understand that there is no fine or penalty associated with this
violation. If this is not correct, please contact me as soon as possible. If you have any questions or
require additional information, please contact me at 415-902-5089 or Daryl.Lee@bp.com.
BP Products North America Inc. reserves all of its rights and defenses associated with this matter.
