<br />Owner Certification and Designated UST Operator Deadline Notification by January 1, 2005
<br />Recently, the State Water Resources Control Board (SWRBC) passed regulations requiring
<br />certification of individuals working with underground storage tank (UST) systems. UST owners
<br />are included in this new requirement. A copy of the SWRBC flyer entitled "ACT NOW",
<br />explaining the responsibilities of UST owners and the deadlines by which you must comply, is
<br />enclosed with this letter.
<br />This second notification is being sent through certified mail so you understand the importance
<br />of the January 1, 2005, deadline to submit the owner's compliance statement (described below)
<br />and identify the ICC certified Designated UST Operator(s)* for all of your underground storage
<br />tank (UST) facilities located within San Joaquin County.
<br />The owner's compliance statement mentioned above is required pursuant to California Code of
<br />Regulations, Title 23, section 2715 (a) which reads:
<br />By January 1, 2005, owners of underground storage tank systems shall
<br />submit a signed statement to the local agency indicating that the owner
<br />understands and is in compliance with all applicable underground storage
<br />tank requirements, and identifying the designated UST operator(s) for each
<br />facility owned. The owner shall inform the local agency of any change of
<br />designated UST operator(s) no later than 30 days after the change.
<br />To help you comply with these requirements, the San Joaquin County Environmental Health
<br />Department (EHD) is enclosing a document entitled "Owner Statements of Designated
<br />Underground Storage Tank (UST) Operator and Understanding of and Compliance with UST
<br />Requirements". To satisfy the requirements, the form must be complete and submitted to EHD's
<br />address on this letterhead before the January 1, 2005, deadline.
