S A N J D AR I N Environmental Health Department <br /> (L)j ;"� i Y <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> PENNY NEWMAN GRAIN 1 1805 HARBOR RD, STOCKTON June 23, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection for oily solids waste. <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Provide a copy of disposal records for the past three years(June 23, 2017 to June 23, <br /> 2020 for oily solids waste. Provide these records and a corrective action statement to the EHD within 30 days. <br /> This is a minor violation. <br /> 608 CCR 66266.130 Failed to properly manage used oil and fuel filters. <br /> OBSERVATION: This facility generates drained used metal oil filters. A complete three year bill of lading record for <br /> used oil filter recycling was not observed during the inspection. Bills of lading were not observed for the following <br /> date range: 6-23-17 to 6-23-20. <br /> REGULATION GUIDANCE: <br /> Persons generating,transporting, or receiving used metal oil filters shall use a bill of lading to record the transfer of <br /> used oil filters. Bills of lading must indicate generator,transporter, and receiving company names, addresses, <br /> telephone numbers,the quantity and size of used oil filter containers transferred, and the date of transfer.A copy of <br /> each bill of lading must be kept on the premises of the generator,transporter, and receiving facility where the used <br /> oil filters were handled. Copies of bills of lading shall be kept for a period of three years. <br /> CORRECTIVE ACTION: Immediately obtain all missing bill of lading recycling records that can be found from the <br /> past three years. Provide a corrective action statement, bill of lading recycling records and supporting <br /> documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. <br /> This is a minor violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by July 23, 2020 . <br /> To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br /> of having them sign. <br /> Documents provided during inspection: Hazardous waste labels <br /> Waste streams found: Used oil, oily solids, metal oil filters. <br /> Used oil, oily solids and metal oil filters drums were closed and labeled during the inspection.
