Approximately 7 gallons. <br /> OBSERVATIONS: <br /> Arrived on site and met with Kristen Dugger(Director of Safety and Environments)of Van De Pol and Jon Lorente(Director <br /> of Compliance and Safety)of eFuel. On 3/29/2020 a Van De Pol tanker was filling up the diesel tanks and the check valve <br /> failed causing a release of approximately 7 gallons of diesel. The original spill covered an approximate area of 5x10 feet. <br /> Release was cleaned up yesterday(3/29/2020)by Fleetwash Services. This morning(3/30/2020), a sheen was noticed on <br /> the containment pond. Fleetwash used approximately 50 gallons of water to clean-up the diesel spill and the runoff went <br /> into the drain. Approximately 1 ounce went into the containment pond. Liquid was observed in several areas of the gutter to <br /> the drain.The inlet pipe to the containment pond was stopped with an absorbent sock. Water was still trickling out of the <br /> pipe into the pond. No sheen was observed on the water in the containment pond. Absorbent pads were observed at the <br /> containment pond.Fremouw Environmental is en route to perform clean-up. Estimated time of arrival is unknown at this <br /> time. Concrete will be power washed, drain pipe will be washed and all waste water will be collected and disposed of as <br /> hazardous waste per Kristen Dugger. <br /> Van De Pol to notify SJC EHD when clean-up is completed so verification can be done. Van De Pol to provided SJC EHD <br /> with final disposal records for the waste generated from the clean-up. <br /> VIOLATIONS: <br /> Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> • Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Within 30 days. <br /> Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
