On <br /> Jan 12, 2016 Universal Waste Recycling accepted 118 pounds of stainless steel turnings from this facility. On June <br /> 8, 2020 Modesto Junk accepted 620 pounds of stainless steel scrap for recycling from this facility. Between these <br /> dates the metal shaving waste from this facility was being placed into the Waste Management dumpster on site for <br /> haul away by their trash collector,Waste Management, according to Jo Munoz, manager of F& H Nozzle <br /> Specialists, Inc. <br /> Records photographed during the inspection show that the metal shaving waste is 10-18%chromium. Metal <br /> chromium waste must be recycled by a metal recycler or disposed of as hazardous waste, if found to be a regulated <br /> hazardous waste per Title 22 California Code of Regulations or California Health and Safety Code. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop placing the metal shaving waste into the Waste Management dumpster <br /> on site. Do one of the following actions to come back into compliance: <br /> 1. Send the metal shaving waste to a metal recycler and keep receipts for each load. <br /> 2. Have the metal shaving waste hauled from the facility as hazardous waste and keep copies of the Uniform <br /> Hazardous Waste Manifests. <br /> 3. Demonstrate that the metal shaving waste is not hazardous waste by testing using methods specified in Title 22 <br /> CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation to the San Joaquin County Environmental Health Department <br /> within 30 days. <br /> This is a repeat violation, Class ll. <br /> 605 CCR 66262.34(f) Failed to completely label containers or portable tanks of hazardous waste. <br /> OBSERVATION: Hazardous waste containers were observed on-site with incomplete labeling. The containers <br /> were:Two 55-gallon drums of used oily liquid was missing the complete accumulation start date . The dates were <br /> labeled "late 2019". <br /> REGULATION GUIDANCE: All hazardous waste containers shall be marked with the following information: the <br /> words"Hazardous Waste", name and address of generator, hazardous properties, physical state, composition <br /> (contents), accumulation start date <br /> CORRECTIVE ACTION: The violation was corrected during the inspection by labeling with the correct dates.
