OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented)that employees who handle hazardous waste were properly trained. According to training records, employees were last trained in "Hazard Communication, Hazardous Waste Management, and Emergency Response and Notification Procedures"on 11/8/2018. REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and emergencies. CORRECTIVE ACTION: Immediately train the employees. Provide proof of training within 30 days to the San Joaquin County Environmental Health Department(EHD)for employees whose responsibilities include hazardous waste. This is a minor violation. 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. OBSERVATION: Designated facility signed copies of Uniform Hazardous Waste Manifest(UHWM)numbers 003732248GBF(dated 4/26/2018)and 00610828OGBF(dated 12/3/2018)were not found on-site. In addition, American Valley Waste Oil, Inc, invoice number 163666, dated 4/10/2018, indicated that there was a"Haz Waste Pick Up-Absorbent, Oil, Diesel, and Antifreeze"under manifest 003639940. That manifest was not found on site. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit a copy of the manifest to the California Department of Toxic Substances Control (DTSC)within 60 days if the destination facility signed manifest copy is not received from the transporter or designated facility. CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy was not received by the generator.
