1 c. Failing to keep hazardous waste containers closed, except when adding or <br /> 2 removing waste,in violation of California Code of Regulations,title 22 section 66265.173(a); <br /> 3 d. Failing to retain copies of signed manifest for at least three(3) years from the date <br /> 4 the waste was accepted by the initial transporter,in violation of California code of Regulations,title <br /> 5 22 section 66262.40(a); <br /> 6 e. Failing to submit return compliance certificate to the authorized local agency in <br /> 7 violation of Health and Safety Code Section 25187.8(b) <br /> 8 5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 9 are doing business in the State of California, in the course of Defendant's GAS STATION activities, <br /> 10 are,pursuant to California Business and Professions Code section 17204,hereby permanently <br /> 11 enjoined from: <br /> 12 a. Violating Health and Safety Code section 25290 et seq.,described in paragraph <br /> 13 3—3n above; and <br /> 14 b. Violating Health and Safety Code section 25181 et seq.,described in paragraph <br /> 15 4—4m above. <br /> 16 6. Defendants shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS ($5,000.00), <br /> 17 as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment shall be made <br /> 18 payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT- <br /> 19 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br /> 20 Joaquin County Office of the District Attorney,Environmental Crimes Unit, as follows: <br /> 21 a. ONE THOUSAND DOLLARS ($1,000.00)on or before January 4,2017; <br /> 22 b. ONE THOUSAND DOLLARS ($1,000.00)on or before July 1,2017; <br /> 23 c. TWO THOUSAND DOLLARS ($2,000.00)on or before January 4,2018; and <br /> 24 d. ONE THOUSAND DOLLARS ($1,000.00) on or before July 1,2018. <br /> 25 7. Defendants shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS ($5,000.00), <br /> 26 as and for civil penalties,pursuant to Business and Professions Code section 17206. Said payments <br /> 27 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San <br /> 28 Joaquin County Office of the District Attomey, Environrnental Crimes Unit, as follows; <br />
