1 c. Failing to keep hazardous waste containers closed, except when adding or 2 removing waste,in violation of California Code of Regulations,title 22 section 66265.173(a); 3 d. Failing to retain copies of signed manifest for at least three(3) years from the date 4 the waste was accepted by the initial transporter,in violation of California code of Regulations,title 5 22 section 66262.40(a); 6 e. Failing to submit return compliance certificate to the authorized local agency in 7 violation of Health and Safety Code Section 25187.8(b) 8 5. Defendant with actual or constructive knowledge of this Injunction, only in so far as they 9 are doing business in the State of California, in the course of Defendant's GAS STATION activities, 10 are,pursuant to California Business and Professions Code section 17204,hereby permanently 11 enjoined from: 12 a. Violating Health and Safety Code section 25290 et seq.,described in paragraph 13 3—3n above; and 14 b. Violating Health and Safety Code section 25181 et seq.,described in paragraph 15 4—4m above. 16 6. Defendants shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS ($5,000.00), 17 as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment shall be made 18 payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT- 19 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San 20 Joaquin County Office of the District Attorney,Environmental Crimes Unit, as follows: 21 a. ONE THOUSAND DOLLARS ($1,000.00)on or before January 4,2017; 22 b. ONE THOUSAND DOLLARS ($1,000.00)on or before July 1,2017; 23 c. TWO THOUSAND DOLLARS ($2,000.00)on or before January 4,2018; and 24 d. ONE THOUSAND DOLLARS ($1,000.00) on or before July 1,2018. 25 7. Defendants shall pay to Plaintiff the sum of FIVE THOUSAND DOLLARS ($5,000.00), 26 as and for civil penalties,pursuant to Business and Professions Code section 17206. Said payments 27 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San 28 Joaquin County Office of the District Attomey, Environrnental Crimes Unit, as follows;
