SAN J 0 A Q I I I Irl Environmental Health Department <br /> CCUN r <br /> Small Quantity Hazardous Waste Generator Inspection Report <br /> Facility Name: Facility Address: Date: <br /> HD SUPPLY CONSTRUCTION SUPPLY WCO23 1 1166 S Wilson Way, Stockton June 29, 2020 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste. <br /> OBSERVATIONS: Spillage of an unknown black powder-like material was observed on the floor in the facility's <br /> warehouse.According to Art Parco, Branch Manager, and Roger Schiaffino,Assistant Branch Manager,the spilled <br /> material was Kleen Blast Premium Non-Silica Abrasive.According to Art, spilled abrasive material is sent off-site to <br /> be recycled. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste <br /> as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> CORRECTIVE ACTION: Immediately stop recycling the spilled abrasive material, make a hazardous waste <br /> determination for the waste, and manage it according to Title 22 CCR. Use Safety Data Sheets(SDS),waste <br /> sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must <br /> be done using methods specified in Title 22 CCR including sections 66261.20-24. <br /> Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br /> storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes <br /> determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your <br /> hazardous waste generator status. <br /> This is a minor violation. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: Spillage from a broken container of Scofield Dry Shake Color Hardener was observed in the <br /> facility's warehouse.The hardener had mixed with water that had spilled from a water hose, according to Art Parco, <br /> Branch Manager. Roger Schiaffino,Assistant Branch Manager, demonstrated on the facility's computer system that <br /> the spilled Scofield Dry Shake Color Hardener is hazardous waste. Roger printed a hazardous waste label for the <br /> spilled material and stated that the spillage will be cleaned up, placed in a 5 gallon bucket, and labeled as <br /> hazardous waste. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately clean up the color hardener spillage. Manage the waste according to Title 22 <br /> California Code of Regulations for hazardous waste.
