Arroyo Smog _1 Page 1 of 2
Lori Duncan [EH]
From: Lori Duncan [EH]
Sent: Friday,April 04, 2008 1:59 PM
To: 'adeicke@advgeoenv.com'
Subject: RE: Arroyo Smog
Art,
Lisa Labrado is already aware that a monitoring and sampling event was scheduled. The site will not
be considered to be in compliance with regulatory directives until a report of the work is submitted, which did not
happen the last time the site was sampled. Reports of work should be submitted within 60 days following
completion of the fieldwork; this deadline was reiterated to the Hernandez's in the 3/13/08 EHD correspondence.
That would be within the 90 day response time required by the cleanup fund to continue processing the claim.
,Per CCR, Title 23, Div. 3, Chapter 16, section 2652(d), owners/operators of contaminated sites must report
quarterly until site investigation and cleanup are complete. Reports must contain conclusions, and
recommendations for further work.
Lori Duncan, Senior REHS
San Joaquin County
Environmental Health Department
lduncan@sicehd.com
(209)468-0337 phone
(209)468-3433 fax
From: Art Deicke [mailto:adeicke@advgeoenv.com]
Sent: Friday, April 04, 2008 10:08 AM
To: Lori Duncan [EH]
Cc: Bob Marty
Subject: Arroyo Smog.
Lori,
Mr. Hernandez received a letter from the USTCF(attached)stating the site was not in compliance.
The site was monitored and sampled on 24 March 2008.
Would you be able to respond to Ms. Labrado of the USTCF and state the site is now in
compliance?
