Box 2498
Danville, CA 94526
Dear Mr. Roy:
R & L DIESEL SERVICE, 2417 WEST LANE, STOCK ON
This is in response to your July 2, 2004 and September 13, 2004 letters in which you request that
the State Water Resources Control Board (SWRCB) issu a site closure letter for R & L Diesel
Service. You describe your letter(s) as a petition seeking review of the San Joaquin-County's
(County) request for sampling and its failure to close youir site. However, since there has not
been a documented unauthorized release from an underground storage tank (UST) at this facility,
the SWRCB does not have the authority to review the Co aunty's action.
The SWRCB has authority to review only.those actions t' ken by a local agency at a site subject
to cleanup, abatement or other action conducted as part of the Local Oversight Program. [Health
& Saf. Code, § 25297.1, subd. (h)]. In this case, the Co my has not confirmed that an
unauthorized release occurred at R & L Diesel Service, and has not directed the responsible
party(ies) to perform corrective action. If a leak is discovered from the UST and the facility is
entered into the Local Oversight Program, then the respo risible party(les) will have the right to
petition the SWRCB to review actions or inaction of the County.
i
Please contact me at (916) 341-5645 or brazellt swrcb. a. ov if you have any questions or wish
to discuss this matter.
Sincerely,
r
Terry Brazl
Underground Storage Tank Program
cc: See next page
I
California Environmental Protection Agency
Recycled Paper
