Under the small load operations,you are not allowed to transport the waste back to your location. It must be taken directly to an authorized facility. Therefore, the variance cannot be issued in this situation. The mobile maintenance operations under Health and Safety Code section 25250.12 allow you to have a point of consolidation at your location for used oil and does not require you to register as a transporter as long as you do not transport more than 55 gallons from off-site locations back to your location. The consolidated used oil would then be transported by a registered transporter(Safety Kleen in your situation)from your consolidation point to a permitted used oil recycling facility.
