Hi Cristina, <br /> The 30 day rule is fine as long as you guys are still working to get back to compliance. You submitted an return <br /> to compliance certification (RTC), which is good. Violation 601 was closed out, I had forgotten that you sent <br /> disposal receipts prior to this RTC, so I closed it out. <br /> As far as the other violations I mentioned what was needed in the email. <br /> Violation 403- The 5 gallon bucket was not mentioned with what you submitted to me, which is why I could not <br /> close this violation. The RTC provided pictures for the other 55 gallon containers, however you did not provide <br /> one for the 5 gallon bucket. Your follow up email mentions that the 5 gallon bucket was cleared out, I need a <br /> more specific response. Did you put the contents with the other used oil and then discontinued use of the 5 <br /> gallon bucket? I need to know what you did with the contents and the bucket itself. <br /> Violation 303- The secondary containment was not mentioned with what you submitted to me, which is also <br /> why I could not close out this violation. Your follow up email states the secondary containment was cleared out <br /> the day before Friday, but what does cleared out mean? Did you transfer the oil into the 55 gallon container? <br /> Or did Sacramento waste oil haul off the oil? If they hauled off the oil then I will need a disposal receipt for this. <br /> Violation 102- Any 3rd party company will take metal shavings, especially if it is mixed in with other scrap metal. <br /> It is not there job to decide if it is hazardous waste or not. This is called Generators knowledge, if you guys are <br /> treating the metal shaving as non- hazardous waste then you have to either provide a Safety data sheet that <br /> states the metal fines are non- hazardous waste or you must do lab testing to prove it is not hazardous waste. <br /> The email I sent earlier explains further how to go about the lab testing portion. The other option is to treat it as <br /> hazardous waste and have a licensed hauler take it, you can contact Sacramento Waste Oil to see if they will <br /> accept the metal fines. <br /> I hope this email helps, if you still need further explanation please call me at my cellphone which I will provide <br /> below, I really want to help make this as easy as possible.
