STOCKTON December 16, 2019 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS ll,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 110 CCR 66262.40(a)Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three <br /> years during the inspection from December 16,2016-December 16, 2019,for hazardous wastes including used oil, <br /> used antifreeze, paper/metal oil filters,and parts wash waste. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste.This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. <br /> CORRECTIVE ACTION: Provide a copy of disposal records from December 16,2016-December 16,2019 for all <br /> hazardous wastes including used oil, used antifreeze, paper/metal oil filters,and parts wash waste. Provide these <br /> records and a corrective action statement to the EHD within 30 days. <br /> This is a Class II violation. <br /> 113 HSC 25160.2(b)(3)Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: Disposal records were not found on site from December 16,2016-December 16,2019,for <br /> hazardous wastes including used oil,used antifreeze, paper/metal oil filters, and parts wash waste. <br /> Department of Toxic Substance Control records indicate that oil(state waste code 221)was picked up on the <br /> following date using consolidated manifesting: <br /> -4/24/2018(85 gallons). <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Immediately locate a copy of all consolidated manifest receipts from December 16, <br /> 2016-December 16, 2019 and the missing oil consolidated manifest listed above. Immediately start to maintain the <br /> records on site.
