I insofar as they are doing business in the State of California and confined to Defendant's 2 AGRICULTURAL FAIR activities in the County of San Joaquin and elsewhere in the State of 3 California. -'. 3. Defendant,with actual or constructive knowledge of this Injunction,only iii so far as they are doing business in the State of California,in the course of Defendant's AGRICULTURAL,FAIR 6 activities,are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: 7 a. Failing to retain a copy of consolidated manifest for at least three(3)years,in 8 violation of Health and Safety Code section 25160.2(6)(3); 9 b. Disposing or causing the disposal of a hazardous or extremely hazardous waste at a 10 point which is not authorized,in violation of Health and Safety Code section 25189.2(c); 11 c. Failing to determine if that waste is a hazardous waste,in violation of California 12 Code of Regulations,title 22 section 66262.11; 13 d. Failing to completely label or mark each container or portable tank used for onsite 14 accumulation of hazardous waste,in violation of California Code of Regulations,title 22 section 15 66262.34(f); 16 e. Failing to retain a copy of each signed manifest for three(3)years or until the 17 generator receives a signed copy from the designated facility which received the waste,in violation 18 of California Code of Regulations,title 22 section 66262.40(a); 19 f. Failing to retain,at generator's place of business for at least three(3)years,a 20 legible copy of each manifest or bill of lading which identifies spent lead-acid storage batteries --" ---21- -shipped-f6 a person who sfoies or uses,-reuses,recycl6s or recfaiins tfe batteries or th6ir comp6nents, 22 in violation of California Code of Regulations,title 22 section 66266.81(a)(4)(B); 23 g. Failing to manage lamps in a way that prevents releases of any universal waste or 24 component of a universal waste to the environment,in violation of California Code of Regulations, 25 title 22 section 66273.33(b); 26 h. Failing to label or mark the universal waste to identify the type of universal waste 27 with the phrase"Universal Waste-Lamps)",in violation of California Code of Regulations,title 22 28 section 66273.34(c); -2- PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
