I Inc.,which are available to all San Joaquin County Hazardous Waste,Underground Storage Tank, <br /> 2 and Aboveground Petroleum Storage Facility Business Owners and Operators,on the following dates <br /> 3 in San Joaquin County: <br /> 4 November 4,2014,Hazardous Material Management Plan/CERS <br /> S November 4, 2014,Universal Waste Management <br /> 6 November 18,2014 or December 9,2014,Basic Hazardous Waste <br /> 7 Management <br /> 8 d. Defendant shall provide proof of completion of all classes to the Environmental <br /> 9 Prosecutions Unit in the form of a written declaration,on or before December 15,2014;and <br /> 10 e. Defendant shall annually for FIVE(5)years,print and distribute Household <br /> 11 Hazardous Waste Disposal Guide literature during the Lodi Grape Festival. <br /> 12 6. The TWENTY-FIVE THOUSAND DOLLARS ($25,000.00)in civil penalties, described <br /> 13 111 paragraph 5 above,shall immediately be due and payable as set forth in paragraph 5 above,if the <br /> 14 San Joaquin County Office of the District Attorney files Declarations that Defendant violated Health <br /> 15 and Safety code sections 25100 et seq.or Business and Professions Code sections 17200 et seq., as <br /> 16 described in paragraphs 3 and 4 above. Any penalties or other relief sought by Plaintiff for such <br /> 17 violations or alleged violations shall be sought by noticed motion. Plaintiff shall notify Defendant in <br /> 18 writing of such alleged violations and shall meet and confer with Defendant within twenty(20) <br /> 19 business days of such written notice prior to filing any such motion. The Parties shall negotiate in <br /> 20 good faith in an effort to resolve any fin-ther penalty assessments or other relief pursuant to this <br /> n. Defendant"reservesal'defensinlawanda 21- -paragTaphwionfJ`udicilintervno — <br /> 22 -- <br /> 7. If all the conditions listed in paragraph 5 above are met,then FIVE (5)years from the <br /> 23 filing date of this document,the stayed penalty shall be suspended permanently. <br /> 24 8. Defendant shall additionally pay to Plaintiff the sum of SEVEN HUNDRED FIFTY <br /> 25 DOLLARS ($750.00)as partial recovery of the cost of investigation and suit incurred by the SAN <br /> 26 JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said payment shall be due <br /> 27 and payable to the aforementioned agency, and shall be delivered to the San Joaquin County Office <br /> 28 of the District Attorney,Environmental Prosecutions Unit,at time of siding. <br /> -4- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
