I Inc.,which are available to all San Joaquin County Hazardous Waste,Underground Storage Tank, 2 and Aboveground Petroleum Storage Facility Business Owners and Operators,on the following dates 3 in San Joaquin County: 4 November 4,2014,Hazardous Material Management Plan/CERS S November 4, 2014,Universal Waste Management 6 November 18,2014 or December 9,2014,Basic Hazardous Waste 7 Management 8 d. Defendant shall provide proof of completion of all classes to the Environmental 9 Prosecutions Unit in the form of a written declaration,on or before December 15,2014;and 10 e. Defendant shall annually for FIVE(5)years,print and distribute Household 11 Hazardous Waste Disposal Guide literature during the Lodi Grape Festival. 12 6. The TWENTY-FIVE THOUSAND DOLLARS ($25,000.00)in civil penalties, described 13 111 paragraph 5 above,shall immediately be due and payable as set forth in paragraph 5 above,if the 14 San Joaquin County Office of the District Attorney files Declarations that Defendant violated Health 15 and Safety code sections 25100 et seq.or Business and Professions Code sections 17200 et seq., as 16 described in paragraphs 3 and 4 above. Any penalties or other relief sought by Plaintiff for such 17 violations or alleged violations shall be sought by noticed motion. Plaintiff shall notify Defendant in 18 writing of such alleged violations and shall meet and confer with Defendant within twenty(20) 19 business days of such written notice prior to filing any such motion. The Parties shall negotiate in 20 good faith in an effort to resolve any fin-ther penalty assessments or other relief pursuant to this n.
