Its Simple, Safe & Legal! <br /> The Doctor, Dentist,Paramedical Examiner,or generator,is liable for all sharps generated by their practice or facility. <br /> Many states have already passed laws requiring properly documented disposal of sharps and are enforcing those laws. <br /> Let.N.E.S.Medical Waste Services,National Environmental Systems,accept the liability from the time you place it in <br /> the mail, through disposal. <br /> It is perfectly legal to send your sharps through the mail. The U.S. Postal Service Regulations are as follows: <br /> N4p.TES Posrq <br /> ® m 124.384 Sharps and Unsterilized Containers <br /> X <br /> 2 5 a. Sharp,such as syringes,needles,and surgical blades,as further described in item(4)in the table following <br /> LLs MAIL m 40 CFR 259.30(a)54 FR 12326, 12374,March 24,1989),must be packaged in rigid, leak-resistant and <br /> * * puncture-resistant containers with sufficient absorbent material to take up any residual fluids.If the primary <br /> *** * *4& container(s)cannot be sealed to prevent leakage,it must be placed in a plastic bag or other leak-resistant <br /> container that can be sealed to prevent leakage.These containers must be placed in an outer fiberboard shipping <br /> container. <br /> b. Unsterilized containers or devices used in laboratory or surgical procedures containing or reasonably <br /> expected to contain an etiologic agent,must be packaged in accordance with 124.383a.Containers or devices <br /> not containing or not reasonably expected to contain an etiologic agent,must be packaged in accordance with <br /> 124.383b. <br /> The Environmental Protection Agency,The Center For Disease Control,The Department of Health and O.S.H.A.all require that <br /> ALL MEDICAL FACILITIES, REGARDLESS OF SIZE, legally handle their sharps and dispose of their medical waste <br /> according to the methods they have described. <br /> O.S.H.A. Instruction CPL 2-2.44A, Office of Health Compliance Assistance, Bureau of Solid Waste Management, and the <br /> Department of Health: <br /> a. Sharp instruments and disposable items. <br /> Needles shall not be recapped, purposely bent or broken by hand <br /> (1) After they are used,disposable syringes and needles,scalpel blades,and other sharp items shall be placed in PUNCTURE- <br /> RESISTANT CONTAINERS for disposal. <br /> (2) Such containers shall be easily accessible to personnel needing them and located in all areas where needles are commonly <br /> used,including emergency rooms, intensive care units,and surgical suites and shall be so constructed that they will not spill <br /> their contents if knocked over and will not themselves allow injuries when handled <br /> (3) These containers shall also be located on patient floors and any other setting where blood is drawn and needles are used. <br /> b.
