The San Joaquin County Environmental Health Department(EHD)has been informed that the water supply on the above-referenced property serves the same 25 or more individuals for six months or more per year, and thereby meets the definition of a Non Transient—Non Community (NTNC) small public water system. As a small public water system owner, you are required to obtain a permit to operate from the EHD and meet the requirements of a NTNG. The EHD received the application for a permit to operate a small public water system and the water sample results, for nitrate analysis, from the water supply well. Based on the averaged nitrate result, the well water exceeds the allowable Maximum Contaminant Level(MCL) for nitrate of 45 parts per million(ppm). The average nitrate result was 70 ppm(April 8, 2003 result of 73 ppm, and April 11, 2003 result of 67 ppm). This is in violation of the Safe Drinking Water Act(SDWA), California Code of Regulations, Title 22, Section 64445.1(a). A permit to operate a NTNC water system at this facility will not be issued due to the failure to meet this primary water quality standard. This facility shall not continue to operate this waster supply as a public water system. Until the facility is able to,meet the requirements of a NTNC, all water used for drinking and food preparation purposes shall be from an approved bulk or bottle water source that is permitted by the state of California as an approved water purveyor. Receipts for the purchased water shall be retained and provided to the EHD upon request. Public Notification that contains the health language for nitrates shall be posted at all faucets for as long as the EHD determines that the violation exists.l To meet the NTNC water quality requirements, a new water source will be required. This can be achieved by one of the following methods: I Any person who operates a public water system without a permit issued by the department(aka EHD)pursuant to this chapter may be liable, as determined by the court, for a civil penalty not to exceed twenty-five thousand dollars($25,000) for each separate violation or, for continuing violations, for each day that violation continues (Health and Safety Code Section 116725 (d)).
