with the deed restriction, and shall occur only with the written <br /> permission of the owner of the property, and any work within <br /> public rights-of-way shall be permitted only with the appropriate <br /> permit. All costs associated with any maintenance of the Site <br /> shall be borne by the owner of the Site. <br /> The owner shall also be responsible for keeping adequate <br /> records to document the on-going status and maintenance of the <br /> Site. Inspections of the Site shall be conducted to verify that <br /> the Site has not deteriorated. EPA recommends that Site <br /> inspections be done on a quarterly basis. Conditions that may <br /> undermine the integrity of the cap shall be corrected by the <br /> owner immediately after their discovery. <br /> Notification to EPA for maintenance is not required, but is <br /> required before additional construction may be done at the Site. <br /> If there are problems or concerns please contact Brad Shipley, <br /> Federal On-Scene Coordinator, Emergency Response Section, U.S. <br /> EPA at (415) 744-2287 or contact the 24-hour spill phone number <br /> at (415) 744-2000. <br /> Lyon Communities, Inc. , was issued written notice on May 16, <br /> 1989 , that it is liable for all costs incurred by the government <br /> in responding to releases or threatened releases at the Site. <br /> Such costs include, but are not limited to, expenditures for <br /> investigation, planning, response, oversight, and enforcement <br /> activities. <br /> A demand for payment letter will be sent in the near future <br /> from EPA requesting Lyon Communities, Inc. , to reimburse EPA for <br /> all associated costs with regard to the Site. A summary report <br /> of EPA costs will be provided to explain these charges and <br /> expenditures.
