Stevens announced today <br /> that a federal grand jury in Sacramento returned a three-count <br /> indictment against FRANK C. ALEGRE; and FRANK C. ALEGRE TRUCKING, <br /> INC. , of Lodi, California, alleging violations Of the Clean Water <br /> Act and the Refuse Act for illegal dumping of pollutants into. the <br /> San Joaquin River and into protected wetlands adjacent to the San <br /> Joaquin River. <br /> count one of the indictment charges that from 1990 to 1993, <br /> ALEGRE, 59, dumped various Pollutants, including truck loads of <br /> garbage, diesel contaminated dirt, sand, broken tile, concrete <br /> and other industrial wastes into wetland areas located on several <br /> hundred acres of property ALEGRE owns along Kasson Road, in <br /> Varnalis, California. The remaining counts of the indictment <br /> charge ALEGRE and his trucking company with dumping Pollutants <br /> directly into the San Joaquin River and along its banks, <br /> including truck loads of garbage, broken tile, concrete and other <br /> wastes. <br /> According to the affidavit in support of a search warrant <br /> executed on ALEGREIS Kasson Road property earlier this week, in <br /> July 1989, the California Department of Fish and Game advised <br /> FRANK ALEGREIS environmental consultant that there should not be <br /> placed any foreign material on ALEGRE'S Kasson Road property. In <br /> July, 1990, ALEGRE was directly advised by the San Joaquin County <br /> Public Health Services, that his placement of garbage and other <br /> materials on his Kasson Road property constituted a violation of <br /> California Water Code, Section 13387 (unlawful disposal of wastes <br /> in a flood plain) and San Joaquin County Solid Waste Disposal <br /> Ordinance Sections 5-2600 and 5-2401 (unlawful operation of a <br /> disposal site without a permit and unlawful disposal of refuse on <br /> premises) , and was ordered to cease and desist immediately. In <br /> January 1992, the San Joaquin County Community Development <br /> Department advised ALEGRE, both in person and in writing, that <br /> ALEGRE was illegally using his Kasson Road property for the <br /> disposal of solid wastes in violation of county zoning ordinances <br />
