1-2C-cil erator or incinerators specified in Section 3(A), of said agree- ment of the 5th day of October, 1959, shall be postponed as hereinafter specified, and until such incinerator or incinerators are constructed, the garbage and refuse which would othertaise be disposed of by means of. the incinerator or incinerators shall be disposed of by the Contractor by means of fill and cover operations. 2. The Contractor shall commence construction of said incinerator or incinerators within sixty (60) days after it has developed additional infor.:iation sufficient to enable the con- tractor to determine the capacity of incinerator or incinerators required, and the incinerator or incinerators shall be in operation within one hundred eighty (180) days after such additional in- formation has been developed, provided, however, that the maximum amount of time allowed for developing such additional information shall be one hundred eighty (180) days from the date of this supplemental agreement. The fill and cover operations shall be dis- continued when the incinerator or incinerators are placed in operation as hereinabove specified. A penalty of ONE HUNDRED AND NO/100 ($100.00) DOLLARS per day shall be paid by Contractor to City for use of the fill and cover operation after the Three Hundred Sixty (360) day time limit provided for herein. 3. The City agrees to pay the Contractor SIX THOUSAND AND N0/100 ($6,000.00) DOLLARS per month during the term of this agreement. It is expressly understood that each month's payment is in consideration of the operation and maintenance of the garbage and refuse disposal services provided by the Contractor during the preceding month. Said payments shall entitle City, its authorized collectors and agents to dispose of Thirty-Five Hundred (3500) tons of garbage and refuse each month. Any• garbage and refuse disposal by the City in excess of Thirty-Five Hundred (3500) tons per month or of Cne Hundred Forty (140) tons during any given day shall incur a charge of T140 AND N0/100 ($2.00) DOLLARS
