8/30/62 <br /> 25. If the Contractor should be adjudged a bankrupt, <br /> or if it should make a general assignment for the benefit of <br /> its creditors, or if a receiver should be appointed on account <br /> of its insolvency, then the City may, without prejudice to any <br /> other right or remedy and after giving the Contractor ten (10) <br /> days' written notice, terminate this Agreement. <br /> If Contractor should refuse or fail, unless an ex- <br /> tension of time is granted by the City, to establish, operate <br /> and maintain the garbage and refuse disposal facility in the <br /> manner and subject to the terms and conditions herein pro- <br /> vided for, or if it should disregard laws or ordinance4_,_ or <br /> otherwise be guilty of a substantial violation of any pro- <br /> vision of this Agreement, then if such violation is not cor- <br /> rected within thirty (30) days after written notice by the <br /> City to Contractor to correct such violation, the City may <br /> thereupon, without prejudice to any other right or remedy, <br /> terminate this Agreement. <br /> In the event Contractor fails to ,accept or is unable <br /> to accept garbage, garden refuse, refuse or other materials <br /> from any source as specified in this Agreement, the City reserves <br /> the right to dispose of said garbage, garden refuse, refuseandother <br /> material in any manner it desires and may levy against the Con- <br /> tractor's bond for any extra expense incurred by City. <br /> Any decision of the City to terminate this Agreement <br /> pursuant to the provisions of this Section 25 shall be by action <br /> of the City Council of City. <br /> 26. It is expressly understood that this Agreement <br /> is subject to termination as provided by Sections 4410 and 4411 <br /> of the Government Code of the State of California, being portions <br /> of the Emergency Termination of Public Contracts Act of 1949, <br /> in the event of a national emergency. <br /> _11- <br /> 110 <br />
