Page 2 <br />Mr. Joe Walker <br />II. Indeterminate Criteria: <br />A. Surface Waters: A determination of compliance with the surface <br />water cri-Eerion will not be made until. a water quality management <br />plan is approved for your area as required under Section 208 of <br />the Clean Water Act, as amended. Upon adoption of such a plan, <br />your site will be revisited and the current indeterminate status <br />resolved. <br />B. Groundwater: Before a determination can be made on this criterion, <br />an evaluation must be made of the adequacy of the existing imnitoring <br />well system for determining groundwater quality. This evaluation <br />will be made by the Board's Engineering Geologist. <br />C. Disease: Conformance with the State Minimum Standard for cover <br />is necessary for compliance with this criterion. One site visit <br />was not sufficient to determine if daily cover is being applied <br />as required. Additional site visits aryl/or aerial observations <br />will be made to determine if daily cover is being applied as required. <br />D. Safety/Bird Hazard to Aircraft: Because the site lies within 10,000 <br />. feet of-an-'a-irport runway used for jet aircraft and the airport <br />has been identified by the EPA as having solid waste related bird <br />problems, a comprehensive evaluation is needed to determine if <br />birds attracted to the site cause a hazard to aircraft. <br />The SWMB is providing a grace period of three months beginning with the <br />date of this letter for you to correct the RCRA non-compliance determina- <br />tions(s) noted above. If you take advantage of this opportunity to upgrade <br />your site you must notify the SWMB in writing of the corrective actions <br />taken before the end of the grace period and request a re-evaluation. <br />Upon this notification, Board staff will schedule a re-evaluation of <br />your site for all RCRA criteria except those classified as needing further <br />investigation. <br />Sites not requesting a re-evaluation before the Expiration of the grace <br />period, and sites failing to met the criteria at the requested <br />re-evaluation, are subject to inclusion on the Open Dump Inventory list <br />that will be sent to the Environmental Protection Agency and published <br />in the Federal Register. <br />Further investigation is required in order to make a determination for <br />the four indeterminate criterion(ia). When the evaluation of the indeterminate <br />criterion(ia) is completed you will be notified of the result in writing <br />and if non-compliance with RCRA is noted a three month grace period will <br />start at that time. <br />
