i <br /> R <br /> e <br /> CHAPTER 4 <br /> Enforcement Options <br /> This chapter discusses the responsibilities of local <br /> enforcement agencies (LEAs) and the Board for regulating Solid <br /> Waste Facilities ( SWF) . The Enforcement Flow Chart in Appendix V <br /> graphically shows the types of enforcement actions that may be <br /> taken and by whom. <br /> LEAs as Primary Enforcers <br /> Local enforcement agencies have the primary responsibility <br /> for ensuring the. correct operation and closure of solid waste <br /> facilities. As agents of the State, they enforce State laws and <br /> regulations and implement Board policies. Types of enforcement <br /> actions that an LEA may take are described on page 60. <br /> An LEA must conduct at least monthly inspections of all <br /> solid waste facilities within its jurisdiction and take <br /> appropriate enforcement actions when violations are identified. <br /> At least one inspection per year must be conducted in conjunction <br /> with Board Enforcement Division staff. <br /> Annual Board Inspections and Reports <br /> In conjunction with the LEA, Board staff conducts annual <br /> facility inspections of all solid waste facilities in California <br /> to determine whether LEAs are meeting their responsibilities. <br /> During a specific time period, Board staff in conjunction with <br /> LEA staff, will inspect each of the solid waste facilities within <br /> the LEA' s jurisdiction [PRC, 43219(a) ) . Board staff will prepare <br /> a State Inspection Report for each facility describing the site 's <br /> compliance status. Two copies of the State Inspection Report <br /> shall be forwarded by Board staff to the LEA within 30 days of <br /> the inspection (PRC, 43219(a) & 45105(a) ) . One for LEA file <br /> records and another for the facility operator . <br /> The sample transmittal letter is shown in Appendix G. <br /> Facilities Evaluation Report <br /> Board staff will prepare a Facilities 'Evaluation Report <br /> (FER) for presentation to the Board, after inspecting all of the <br /> facilities within an LEA's jurisdiction. <br /> The PER will contain two recommendations to the Board <br /> relating to: <br /> ( 1 ) LEA performance, and <br /> 58 <br />
