EI Dorado Street <br /> Stockton, CA 95202 <br /> Re: Compliance Agreement for City of Stockton Austin Road Landfill, Facility No. <br /> 39-AA-0001, San Joagiun County <br /> The City of Stockton, as operator of the Austin Road Landfill is hereby notified that <br /> as of October 9, 1993 the return of gas condensate to the landfill is prohibited. This <br /> includes any and all gas condensate returned to the landfill through leach lines, <br /> condensate traps and by any other means. <br /> To demonstrate progress toward this end, we request your compliance with the <br /> following: <br /> 1. Begin testing the return condensate and/or the wastewater collected by in-line <br /> traps to determine If the condensate is a hazardous waste. Apply criteria <br /> specified in CCR, Title 22, Article 11. The initial testing must be completed by <br /> August 1, 1992 with results submitted to the CIWMB Permitting and <br /> Compliance Division, the RWQCB and San Joaquin County Environmental <br /> Health Division (LEA) by August 31, 1992. Test again on April 1, 1993 and <br /> submit results to the above listed agencies by April 30, 1993. If test results <br /> indicate the condensate is a hazardous waste, the continued disposal of <br /> condensate to the landfill will be immediately prohibited, irrespective of the <br /> October 9, 1993 deadline. <br /> 2. Submit a report delineating disposal options for the landfill gas condensate by <br /> October 30, 1992 to the CIWMB, RWQCB, and the LEA. <br /> 3. Submit a report specifying the preferred disposal method and quarterly reports <br /> thereafter demonstrating the City's progress in initiating this method. Submit <br /> the initial report by January 29, 1993. Submit quarterly progress reports by <br /> April 30, 1993 and July 30, 1993. Submit all reports to the CIWMB, RWQCB <br /> and the LEA. <br /> Failure to observe any of these compliance issues and corresponding schedules <br /> will delay the issuance of a new Solid Waste Facilities Permit or may result in <br /> revocation of the current Permit and/or Notice and Order. <br /> Signature Date <br /> Signature Date <br />
