As a result of this <br /> directive, Board staff received a draft Notice and Order (N&O) , <br /> dated July 1, 1991, for the "Solid Waste Permit 139-AA-0001, City <br /> of Stockton Austin Road Landfill" , to be issued by your office to <br /> the City of Stockton Public Works Department. <br /> As a part of preparing comments for the draft N&O, appropriate <br /> Board files were reviewed. In addition, Board staff visited the <br /> site on July 5, 1991 and conducted a State Inspection on September <br /> 19, 1991. Staff also reviewed the draft N&O with regards to <br /> criteria specified in California Code of Regulations (CCR) , Title <br /> 14 , Section 18304 . Based on this review process, Board staff offer <br /> the following comments: <br /> The issuance of a "cease and desist" order is one enforcement <br /> method to prohibit the continued disposal of condensate. If you <br /> choose this course of action Board staff suggest that a <br /> determination be made as to the nature of the condensate waste. <br /> The facility operator should be directed to require testing to <br /> determine if the landfill gas condensate is a "hazardous" waste <br /> using criteria for identification specified in CCR, Title 22 , <br /> Article 11. This determination will assist you in determining the <br /> time schedule of compliance, urgency, and regulatory laws and <br /> regulation (i.e. hazardous waste laws, control of leachate, etc. ) <br /> for resolution of this matter. <br /> An alternative enforcement method to prohibit the continued <br /> disposal of condensate back into the fill is possibly through the <br /> permit revision process. Board Permit staff provided comments to <br /> your agency regarding a draft Solid Waste Facilities Permit (SWFP) <br /> and Permit Review Report for the Austin Road Landfill on July 17, <br /> 1991.
