EHD has designed this letter to enhance your understanding of what <br />is expected and required from the Subtitle D emergency regulations approved by Office of <br />Adminisstrative Law on July 12, 1993. This letter is not to be construed as the full text of the <br />requirements and regulations and in no way supersedes any letter or documents published by <br />the US EPA or Cal EPA regarding Subtitle D regulations. The purpose of this letter is only to <br />shed more light onto the effect of Subtitle D regulations concerning the landfills in San Joaquin <br />County. <br />A plan must be submitted within 30 days to EHD on how your landfill will comply with the new <br />regulations of Subtitle D listed below: <br />Definition - A municipal solid waste landfill (MSWLF) unit is defined as a discrete area <br />of land or an excavation that receives household waste, and that is not a land application <br />unit, surface impoundment, injection well or waste pile. MSWLF units may also receive <br />other types of RCRA Subtitle D wastes, such as commercial solid wastes, non -hazardous <br />sludge, small quantity generator waste, and industrial solid waste and may be publicly <br />or privately owned. A MSWLF unit may be a new MSWLF unit, an existing MSWLF unit <br />or a lateral expansion. <br />1 Municipal solid waste landfill units that receive waste after October 9, 1991 but stopped <br />receiving waste before October 9, 1993 are exempt from all the requirements of CCR <br />Title 14 Division 7, Article 4.5. However, these MSWLF units are not exempt from the <br />final cover minimum standards specified in Section 17773 and all other applicable <br />requirements of Chapter 3 and 5, Division 7, Title 14 of CCR. The final cover must be <br />installed within 6 months of the last receipt of wastes. Owners or operators of these <br />MSWLF units that do not complete the cover installation within the 6 month period will <br />be subject to all the requirements of CCR Title 14, Division 7, Article 4.5. <br />2) Owner and operators of all new and existing landfills, and lateral expansions that are <br />located within 10,000 feet of any airport runway end used by turbojet aircraft or within <br />A Division of San Joaquin County Health Care Services 0 <br />
