• <br />C� <br />'California Integrated,Waste Management Board <br />Permit Deon No. 93-85 <br />July 29, 1993 <br />WHEREAS,'the City of Stockton operates.the Austin Road <br />Landfill which has a past history of operating in violations of <br />state minimum standards, including intermediate cover, litter <br />control, grading of fill surfaces, liquid wastes and leachate <br />control, as documented by Board staff in State Inspection <br />Reports; and <br />WHEREAS, the Central Valley Regional Water Quality.Control <br />Board has determined that the Austin Road Landfill has <br />significantly impacted groundwater; and <br />WHEREAS, the Central Valley Regional Water Quality Control <br />Board has determined that the operator is currently in <br />conformance with Waste Discharge Requirements Order No. 90-122 <br />issued for the landfill and Order No. 92-143 issued for surface <br />water runoff, which require the operator to monitor and evaluate <br />groundwater contamination and surface water, and to implement <br />corrective action to remediate groundwater contamination; and <br />WHEREAS, the San Joaquin County Public Health Services, <br />Environmental Health Division, acting as the Local Enforcement <br />Agency, determined on May 21, 1990, that the facility was <br />disposing of more waste than allowed by its 1983 Solid Waste <br />Facility Permit and issued a Notice and order on April 2, 1991, <br />to the City of Stockton restricting the daily tonnage and <br />requiring a permit revision; and <br />WHEREAS, the San Joaquin County Public Health Services, <br />Environmental Health Division, acting as the Local. Enforcement <br />Agency, has ordered the city of Stockton to test and to cease <br />recirculating landfill gas condensate to the disposal area by <br />October 9, 1993; and <br />WHEREAS, the County prepared a Negative Declaration in <br />compliance with California Environmental Quality Act (CEQA); and <br />WHEREAS, the project description in the CEQA document is <br />consistent with the proposed permit; and <br />WHEREAS, San Joaquin County Public Health Services, <br />Environmental Health Division, acting as the Local Enforcement <br />Agency, has submitted to the Board for its review and concurrence <br />in, or objection to a revised Solid Waste Facilities Permit for <br />Austin Road Landfill; and <br />WHEREAS, Board staff have evaluated the proposed permit for <br />consistency with the standards adopted by the Board and found the <br />facility design and operation in compliance with State Minimum <br />Standards; and <br />
