Consistency with Waste__.Diversion Ke_qgirgments <br /> Staff of the Board's Planning and Local Assistance Division <br /> make an assessment, pursuant to PRC 44009, to determine if <br /> the record contains substantial evidence that the proposed <br /> project would impair or impede the achievement of waste <br /> diversion goals. Based on available information, staff have <br /> determined that the issuance of the proposed permit would <br /> neither prevent nor significantly impait the City of <br /> Stockton from meeting its waste diversipn goals. The <br /> analysis used in making this determination is included as <br /> Attachment 4. <br /> 4. The City of <br /> Stockton Community Development Depart:me34t prepared a <br /> Negative Declaration (SCH# 90020688) for the proposed <br /> project. The document was certified as -approved by the lead <br /> agency on December 3, 1990, and a Notice of Determination <br /> was filed on December 4, 1990. <br /> After reviewing the environmental docum6ntation for the <br /> project, Board staff have determined thit CEQA has been <br /> complied with, and that the Negative Derlaration is adequate <br /> and appropriate for the Board's use in evaluating the <br /> proposed permit. . <br /> The LEA has made the determination thatthe facility's <br /> design and operation is in compliance with the State Minimum <br /> Standards for Solid Waste Handling and Iii sal based on <br /> their review of the submitted Report of Facility <br /> information, supporting documentation, and their inspection <br /> of the site on June 25, 1993. That inspection was conducted <br /> with Board staff and the State Inspecti-6n also documented no <br /> violations of State minimum Standards. <br /> 6. Financial �issurance <br /> The City of Stockton has established an:acceptable financial <br /> mechanism, in the form of enterprise fund to cover the <br /> estimated closure and postclosure maintenance costs of this <br /> facility. This mechanism meets the finAncial assurance <br /> requirements of Title 14 of the caUforiia, code of <br /> Regulations. In addition, based on the -data provided by the <br /> operator, the fund balance is adequate. . <br />
