Mr. Mike Niblock <br /> January 7, 1993 <br /> Page 4 <br /> Airport Safety <br /> Page III .A.24 of the DEIR states, "The proposed project would <br /> be located approximately 7, 500 feet south of the Stockton <br /> Metropolitan Airport runway. " However, Figure III .B . 1 of the <br /> DEIR indicates that the proposed project is within 3 , 000 feet <br /> of the runway. Please clarify. <br /> Mitigation Measure A. 3 . (a) states, "The project sponsor shall <br /> request FAA review of the proposed project and, specifically, <br /> bird abatement programs . The project sponsor shall abide by <br /> any additional reasonable and feasible measures designed by <br /> this agency to mitigate bird population impacts that could be <br /> caused by the proposed project . " CIWMB staff request that <br /> the above mitigation measure be modified to include review by <br /> the CIWMB and local enforcement agency (LEA) . In addition, <br /> the airport should be notified. <br /> Note: Federal regulation 40 CFR 258 . 10, recently incorporated <br /> into 14 CCR 17258 . 10, Airport Safety, requires the following: <br /> (a) Owners or operators of new MSWLF units, existing MSWLF <br /> units, and lateral expansions that are located within <br /> 10, 000 feet of any -airport runway end used by turbojet <br /> aircraft or within 5, 000 feet of any airport runway end <br /> used by piston-type aircraft must demonstrate that the <br /> units are designed and operated so that the MSWLF unit <br /> does not pose a bird hazard to aircraft . <br /> (b) Owners or operators proposing to site new MSWLF units and <br /> lateral expansions within a five-mile radius of any <br /> airport runway end used by turbojet or piston-type <br /> aircraft must notify the affected airport and the FAA. <br /> (c) The owner or operator must place the demonstration in the <br /> operating record and notify the CIWMB that it has been <br /> placed in the operating record. <br /> Ai.r 4uality <br /> Mitigation Measure G. 5 (a) of the DEIR states, "The project <br /> includes the design and implementation of a landfill gas <br /> recovery system to ensure efficient destruction of odoriferous <br /> substances . " What procedures will be implemented in the event <br /> odor complaints are received? <br /> Y <br />
