What will be the thickness and permeability <br /> of the berm material? <br /> Household Hazardous Waste Storage <br /> The DEIR indicates that the proposed project would include a <br /> portable chemical storage locker with a double containment <br /> system for temporary storage of hazardous materials screened <br /> from the landfill . Hazardous waste storage at the facility <br /> may require a permit and/or Hazardous Waste Generator ID <br /> Number from the Department of Toxic Substances Control (DTSC) . <br /> The project proponent should contact the DTSC for assistance <br /> in determining permit and other requirements . <br /> Statement of Overriding Considerations <br /> The decision-making body of the Lead Agency, is responsible for the <br /> certification of the completeness of the Environmental Impact <br /> Report (EIR) after reviewing and considering the information <br /> presented in the document (Title 14, California Code of Regulations <br /> (CCR) , Section 15090) . <br /> CEQA Guidelines, Article 7, Section 15091 (a) , states : <br /> "No public agency shall approve or carry out a project <br /> for which an EIR has been completed which identifies one <br /> or more significant environmental effects of the project <br /> unless the public agency makes one or more written <br /> findings for each of those significant effects, <br /> accompanied by a brief explanation of the rationale for <br /> each finding. " <br /> Page III .G. 19 of the DEIR states, "the cumulative air quality <br /> effect after mitigations would still be significant . " However, the <br /> DEIR does not identify this as an unavoidable significant <br /> cumulative environmental impact in the section on cumulative <br /> impacts . This section only identifies the disruption of the <br /> physical arrangement of the surrounding community, an aesthetic <br /> impact, as an unavoidable significant cumulative environmental <br /> impact . <br /> The Lead Agency has the authority to approve projects despite <br /> significant effects under 14 CCR 15043 . The Statements of <br /> Overriding Considerations should be written according to the <br /> guidelines outlined in 14 CCR 15093 , taking into consideration <br /> Section 21002 of the Public Resources Code. Air quality should be <br /> included in the Statements of Overriding Considerations . <br />
