Mr. Mike Niblock
January 7, 1993
Page 7
berms be located? What will be the thickness and permeability
of the berm material?
Household Hazardous Waste Storage
The DEIR indicates that the proposed project would include a
portable chemical storage locker with a double containment
system for temporary storage of hazardous materials screened
from the landfill . Hazardous waste storage at the facility
may require a permit and/or Hazardous Waste Generator ID
Number from the Department of Toxic Substances Control (DTSC) .
The project proponent should contact the DTSC for assistance
in determining permit and other requirements .
Statement of Overriding Considerations
The decision-making body of the Lead Agency, is responsible for the
certification of the completeness of the Environmental Impact
Report (EIR) after reviewing and considering the information
presented in the document (Title 14, California Code of Regulations
(CCR) , Section 15090) .
CEQA Guidelines, Article 7, Section 15091 (a) , states :
"No public agency shall approve or carry out a project
for which an EIR has been completed which identifies one
or more significant environmental effects of the project
unless the public agency makes one or more written
findings for each of those significant effects,
accompanied by a brief explanation of the rationale for
each finding. "
Page III .G. 19 of the DEIR states, "the cumulative air quality
effect after mitigations would still be significant . " However, the
DEIR does not identify this as an unavoidable significant
cumulative environmental impact in the section on cumulative
impacts . This section only identifies the disruption of the
physical arrangement of the surrounding community, an aesthetic
impact, as an unavoidable significant cumulative environmental
impact .
The Lead Agency has the authority to approve projects despite
significant effects under 14 CCR 15043 . The Statements of
Overriding Considerations should be written according to the
guidelines outlined in 14 CCR 15093 , taking into consideration
Section 21002 of the Public Resources Code. Air quality should be
included in the Statements of Overriding Considerations .
