flow of a stream, substantially alter its bed or bank,or use any material from the streambed, must <br /> first enter into a"Streambed Alteration Agreement"with CDFG. <br /> REGIONAL <br /> WATER QUALITY CONTROL BOARD . <br /> The Regional Water Quality Control Board, San Francisco Bay Region(RWQCB)under the <br /> California State Water Resource Control Board(CSWRCB),is responsible for maintenance of <br /> water quality within San Francisco Bay and adjoining waters. The RWQCB can require a project <br /> proponent to obtain a Section 401 (Clean Water Act)water quality certification for Nationwide <br /> permits granted by the Corps. For less than one acre,the Board issues a waiver,provided the <br /> applicant is also applying to the California Department of Fish and Game for a Stream Alteration <br /> Agreement as noted above. The RWQCB has 60 days to issue this waiver. Between one and <br /> two acres, a waiver could also be issued but only after a thorough review of any agency or public <br /> comments during the 40-day comment period on the Corps public notice(assuming that the <br /> Corps has required an individual permit). For more than two acres of wetland removal,the <br /> RWQCB requires a mitigation plan, a public hearing, and approval of the water quality <br /> certification by the State Water Resources Control Board as an item on their agenda. In the event <br /> of a conflict between the State and the Corps,or,in those rare instances where the Corps may not <br /> ihave jurisdiction,the Regional Board(RWQCB)has independent authority under the State Water <br /> ! Code to regulate discharges to wetlands through waste discharge requirements or other orders. <br />
