Austin Road Landfill ion Project <br /> The length of the re-enrolled Williamson Act contract for the Brocchini parcel would be seven <br /> years or less. If the new owners initiate a non-renewal when the landfill is transferred then the <br /> Brocchini parcel would be restricted to agricultural uses for up to seven years.In the plan for the <br /> landfill expansion, the Brocchini parcel is designated for,floodplainAvildlife preserve and Phases <br /> III and IV of the landfall expansion. Phase 111 is scheduled to begin construction ten years after <br /> the beginning of Phase I, and Phase IV is scheduled to begin 16 years after Phase L Thus, <br /> conversion of portions of the Brocchini parcel to landfill use would not occur until the <br /> Williamson Act contract had expired assuming the new owner initiates a non-renewal at the time <br /> of purchase of the landfill. <br /> Mitigation A-7(a)As appropriate, and in consultation with the State Department of Conservation, <br /> implement one of the following measures to assure Williamson Act consistency: <br /> 1) Reenroll the Brocchini parcel in a Williamson Act contract or encumber the parcel with an <br /> enforceable restriction with terms at least as restrictive as those provided by Government Code <br /> Section 51295, with a duration determined in accordance with the requirements of Section <br /> 51295; or <br /> 2) The County may make applicable findings to cancel the Williamson Act contract on the <br /> affected parcel;or <br /> 3) The State may reevaluate the situation and if appropriate, determine that the parcel does not <br /> require renrollment because Section 51295 does not apply in this case;or, <br /> 4) The parcel would be reenrolled in the Williamson Act but the State may consider the proposed <br /> landfill use compatible with the Williamson Act, as permitted under County Williamson Act <br /> implementing policies. <br /> Provide written notice to the State Director of Conservation and the local governing body <br /> responsible for the administration of the agricultural preserve in accordance with the <br /> requirements of Section 51295. <br /> Implementation of this mitigation measure would reduce the level of impact to less-than- <br /> significant." <br /> 38 <br />
