Gau, Senior Civil Engineer <br /> San Joaquin County <br /> Community Development Department <br /> 1810 East Hazelton <br /> Stockton, California 95205-3163 <br /> N Dear Mr. Gau: <br /> The Department of Fish and Game (DFG) has reviewed the draft Supplemental <br /> Environmental Impact Report (EIR) for the Austin Road Landfill project (SCH# 90020718). <br /> The project is located east of Stockton, in San Joaquin County. The project consists of a plan to <br /> sell the existing Austin Road Landfill, owned by the City of Stockton, to a private operator, <br /> thereby de-annexing the landfill from the City of Stockton. This process will require that San <br /> Joaquin County initiate a General Plan Amendment, Re-Zone, and County Use Permit to operate <br /> the 402-acre landfill. <br /> Wildlife habitat resources consist of the existing landfill, adjacent agricultural ruderal <br /> habitats, and the North Branch of the South Fork Little Johns Creek. Significant resources at the 1 <br /> project site include habitat for sensitive species including the State-listed threatened Swainson's <br /> hawk (Buteo stivainsoni). <br /> We would like to take this opportunity to insure that the project proponent is advised that <br /> work consisting of, but not limited to, diversion or obstruction of the natural flow or changes in <br /> the channel, bed or bank of any river, stream, or lake will require a DFG Streambed Alteration <br /> Agreement (Fish and Game Code Section 1600 et sec.). <br /> The resource protection conditions which are made a part of the Streambed Alteration 2 <br /> Agreement are subject to CEQA review and should be included in the EIR for this project. <br /> Mitigation for the project must include, but may not be limited to the following: <br /> 1. Protect and maintain the riparian, wetland, stream or lake systems and to ensure a"no net <br /> loss" of riparian, wetland, stream, or lake habitat value or acreage. Vegetation removal <br /> should not exceed the minimum necessary to complete operations. <br /> 43 <br />
