17/ DEC-28-1999 16:43 FROM CA I rITEURATED WASTE PONT Tu 91205468316:3 u <br /> ARLF°ExP ansion SEIR • <br /> December 28, 1999 <br /> Page two of three <br /> • Diversion of the North Branch of the South Fork of Little Johns Creek,which currently flows <br /> between the proposed landfill expansion area and the existing landfill. <br /> The expansion project would be implemented in a total of six phases.each consisting of a portion of the <br /> horizontal expansion or the existing vertical expansion of the existing landfill. Closure of the last phase <br /> (Phase VI)would be approximately 48 years after initiation of construction of the first phase. As <br /> discussed in the 1994 EIR, approximately 219 acres of prime agricultural land would be converted to <br /> landfill use. The expansion area consisted of three separate parcels; 125 acres acquired from the <br /> California Youth Authority(CYA), 83 acres acquired from Albert Brocchini Farms,Inc., and an 1 I-acre <br /> Triangular Property acquired from the CYA. Necessary permits were obtained from the Regional Water <br /> Quality Control Board,the I WMB, and the US Army Corps of Engineers. The expansion is included in <br /> the Siting Element of the San Joaquin Countywide Integrated Waste Management Plan,dated April 1996. <br /> While the landfill expansion was initiated, it has not been completely implemented. <br /> The City of Stockton now proposes to sell the permitted landfill(including the expansion option and <br /> permits already obtained)to a private solid waste management firm. Currently,the landfill site is a non- <br /> contiguous City island since it is owned and operated by the City. Except for the approved realignment of <br /> the North Branch of the South Fork of Little Johns Creek,the proposed expansion project has not <br /> changed from that analyzed in the certified 1994 EIR. Also,certain!?tkgrrnmd'conditions may have <br /> changed since that date. Because the landfill is located outside the City limits,the jurisdiction of the land <br /> occupied by the landfill will revert from the City to the County of San Joaquin(County)when the landfill <br /> is transferred to private ownership. Thus,the proposed private ownership and operation of the expanded <br /> landfill site will require a County Use Permit, General Plan Amendment, and zone reclassification. With <br /> the exception of these County approvals and transfer of landfill ownership and operation,the other <br /> required permits for the expansion and operation of the ARLF would remain in effect. <br /> Therefore, pursuant to the California Environmental Quality Act(CEQA),the projects addressed by this <br /> Draft SEIR are the County's issuance of the Use Permit, a General Plan Amendment,and a zone <br /> reclassification,as well as the necessary revision to the City's General Plan to reflect transfer of the <br /> facility from the City to County jurisdiction. Areas of the CYA parcel set aside for a MRF and a <br /> composting or co-composting area would require separate environmental analysis and review if these <br /> facilities are ultimately considered for development and operation. <br /> Agency Background Information <br /> RoIe of the IWMB <br /> The Board must ensure that local solid waste facilities SWFs meet required state Standards for the <br /> protection of public health, safety, and the environment.The Board implements this goal through <br /> programs such as: permit oversight for solid waste facilities; certification and evaluation of Local <br /> Enforcement Agencies which administer specific provisions of Assembly Bill(AB)939, <br /> otherwise known as the Integrated Waste Management(IWIvI)Act; review of environmental <br /> documents for proposed,new or expanded solid waste facilities for compliance with CEQA; <br /> enforcement of'state standards for solid waste facilities;corrective action programs for facilities <br /> out of compliance with state standards; and research and development for special waste <br /> management issues. <br /> 49 <br />
