� a <br /> Extension of UP 99-17 ND t <br /> i <br /> February 4,2002 <br /> Page 2 of 3 <br /> Enforcement Agencies (LEA); review of environmental documents for proposed, new or <br /> expanded SWFs for compliance with CEQA; enforcement of state standards for SWFs; <br /> corrective action programs for facilities out of compliance with state standards; and research and <br /> development for special waste management issues. <br /> CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) REVIEW <br /> CEQA compliance is required for the establishment, expansion, or change in operation(s) of a <br /> SWF requiring the issuance or revision of a Solid Waste Facility Permit(SWFP). IWMB staffs <br /> review of the ND is to help decision-makers (1) identify potential impacts from proposed <br /> projects, (2) determine whether any such impacts are significant, and (3) ascertain whether <br /> significant impacts can be mitigated to a level of insignificance in compliance with the CEQA <br /> statute and guidelines. In order for IWMB staff to ascertain that the ND is complete and <br /> adequate for our use in the SWFP permitting process, the proposed project should be described <br /> in sufficient detail and the potential environmental impacts must be identified clearly in the <br /> environmental assessment/Initial Study Section of the ND. Mitigating measures to reduce <br /> potentially significant environmental impacts should be incorporated into the project, when <br /> feasible, in order to avoid potentially significant effects upon project implementation. When a <br /> potential significant environmental effect is identified and an argument is made as to why no <br /> mitigation is necessary, the discussion/analysis should be in sufficient detail that the <br /> reviewer/decision maker can understand the lead agency's reasoning for their determination. In <br /> order to expedite document preparation and minimize redundancy - supporting documentation <br /> and/or studies would be helpful and should be incorporated by reference in the ND. <br /> ERS STAFF COMMENTS and/or QUESTIONS <br /> The project, as proposed in the ND, is for the local approval of a one year time extension of <br /> UP 99-17 for the Austin Road Landfill expansion. There is no proposal in this ND for any <br /> physical changes in the design or operations of the Austin Road/Forward Landfill (AR/FLF) <br /> requiring a revision SWFP No. 39-AA-0001, nor is there any proposal in this ND of changes of <br /> any sort at the Forward, Inc., Landfill, SWFP No. 39-AA-0015. If physical changes at either of <br /> these facilities are intended, then further CEQA analysis and review would be required. <br /> ERS staff have no further comments on project proposal at this time. The ERS staff requests <br /> notification of any issues in the future affecting the AR/FLF including notice of any public <br /> meetings/hearings on this proposal project. Staff also requests copies of(and consultation on) <br /> any subsequent environmental documents for the AR/FLF. <br /> Thank you for the opportunity to comment on the ND.
