III. Environmental Setting,Impacts,and Mitigations <br /> A. Land Use,Plans and Policies <br /> regional plans. The existing landfill site is owned and operated by the City of Stockton and has <br /> been annexed by the City from San Joaquin County effective November 15, 1984. The City has <br /> acqaired the proposed expansion area to the north from the CYA,although this land is part of the <br /> unincorporated County. The proposed expansion area to the south(Brocchini Property)lies <br /> outside the City of Stockton General Plan Urban Service Area Boundary and would be acquired <br /> under the project. These properties would not need to be annexed because according to the <br /> recent court case,Lawler vs.City of Redding-(1992)(7 Cal.App.4th 778;9 Cal.Rptr.2d 392), <br /> cities and counties are exempt from each other's building and zoning regulations,including <br /> compliance with general plans. Therefore,the City of Stockton does not need to obtain approval <br /> from San Joaquin County for use of County unincorporated area lands that are part of the <br /> proposed project. However,according to the requirements of Public Resources Code Section <br /> 50000.5, "Until a countywide integrated waste management plan has been approved by the <br /> C ...,no person shall establish or expand a solid waste facility or transformation facility <br /> unless the city or county in which the site is located makes a finding that the establishment or <br /> expansion of the facility is consistent with the applicable general plan of the city or county." A <br /> facility shall be deemed to be consistent with the general plan only if both of the following <br /> requirements are met: "the facility is located in a land use area designated or authorized for solid <br /> waste facilities in the applicable city or county general plan and the land uses which are <br /> authorized adjacent to,or near,the facility are compatible with the establishment,or expansion <br /> of,the solid waste disposal facility or transformation facility. <br /> Therefore,any proposed expansion areas in the County,not annexed by the City,would require a <br /> finding of consistency with the County General Plan by the County Board of Supervisors(Paul, <br /> 1993). <br /> The proposed project site is also within the Planning Area boundaries,urban services area <br /> (except for the Brocchini Property,as noted above)and the future growth area set forth in the <br /> City of Stockton General Plan. Consequently,the project would be subject to the goals, <br /> guidelines and policies established in the City of Stockton General Plan. Following are relevant <br /> policies of the Stockton General Plan,along with interpretive analysis of how the proposed <br /> project may or may not be in conformance with those policies. The existing City of Stockton <br /> General Plan City Limits Map does not show the existing Austin Road Landfill as having been . <br /> annexed by the City. . <br /> III.A.3 <br />
