AB 939 requires a 25 percent <br /> diversion from the solid waste strem going to landfills by the year 1995 and 50 percent <br /> diversion by the year 2000. <br /> Under AB 939,counties in California must prepare a County Integrated Waste Management Plan <br /> ( )to replace the County Solid Waste Management plan(CoS ). The C for <br /> San Joaquin County is not complete. <br /> In the interim,AB 2296,often referred to as the"Gap Bill," specifies procedures for planning, <br /> approving,and siting solid waste projects during the transition period when CIWMPs are being <br /> developed to replace CoSWMPs as the counties'primary solid waste planning document. <br /> Pending approval of the CIVIMP by the CIWMB,no city or county may establish a new or <br /> expand an existing solid waste facility which will result in a"significant increase" in the <br /> throughput capacity at the facility unless the Local Enforcement Agency )certifies one of <br /> the following: <br /> • The proposed facility is identified and described in or found to conform with the most <br /> recently approved CoS ; <br /> • 7be proposed facility has been approved by a double majority within the county(the <br /> county and the majority of the cities with the majority of the population in the incorporated <br /> areas of the county);or <br /> • The proposed facility is a materials recovery facility(MRF)that is designed to recover for <br /> reuse or recycling at least 15 percent of the total throughput volume of the facility. <br /> County Solid Waste Management Plan(CoS ) <br /> The California Solid Waste Management Resource Recovery Act of 1972 required that each <br /> County prepare and submit a comprehensive Solid Waste Management Master Plan,with <br /> concurrence of a majority of the Cities within the County. The CoSVVMP concludes that future <br /> replacement of existing landfills should possibly include expansion of existing sites. <br /> The CoSWMP study encourages the collection and use of natural gas at the Austin Road landfill, <br /> and calls for the expansion of the Austin Road Landfall during the 1991-2010 period. <br /> M.A.18 <br />
