SECTION 2 (03/08) SECTION 2. PROPOSAL REQUIREMENTS AND CONDITIONS 2-1.01 GENERAL--The bidder's attention is directed to the provisions in Section 2, "Proposal Requirements and Conditions," of the Standard Specifications and these special provisions for the requirements and conditions which he must observe in the preparation of the proposal form and the submission of the bid. In lieu of the provisions in Sections 2-1.05, "Proposal Forms," 2-1.07, "Proposal Guaranty," and 2-1.105, "Previous Disqualification, Removal or Other Prevention of Bidding," of the Standard Specifications, the following provisions shall apply. 2-1.01A PROPOSALS.--Proposals must be made on forms to be obtained at the office of the Director of Public Works, 1810 E. Hazelton Avenue, Stockton, California, and delivered in a sealed envelope as required in the "Notice to Contractors" and so marked as to indicate the contents and the name of the bidder. Mailed proposals shall be clearly marked on the outsidg of the mailing envelope to indicate the contents and the name of the bidder. Proposals which are not properly marked may be disregarded. 2-1.01 B BID BOND.--All proposals must be accompanied by a certified check, cashier's check or bid bond of a corporate surety made payable to the County of San Joaquin, for a sum of at least ten percent (10%) of the amount of bid. The bid bond shall be signed by both principal and surety with each signature acknowledged before a Notary Public. The bid bond shall also contain the name, address and telephone number of the local agent of the surety. Such guarantee to be forfeited to said County.should the bidder to whom the contract is awarded fail to enter into a contract. 2-1.01C BIDS.--Bids are e required for all work. When more than one n schedule of work to be performed is included, the lowest bid shall be the lowest total of the bid prices on the Base Contract and those schedules taken in order as they appear in the proposal and added to the base contract that are less or equal to a funding amount to be read publicly prior to bid opening. If no bids are less than the stated amount, the lowest bid shall be the lowest cost base bid submitted. A responsible bidder who submitted the lowest bid as determined by this section shall be awarded the contract, if it is awarded. This section does not preclude the local agency from adding to or deducting from the contract any of the schedules after the lowest responsible bidder had been determined. 2-1 (SPEMCO-MCO-2-1)
