SECTION 5 <br /> '- (04/03) <br /> SECTION 5. GENERAL <br /> SECTION 5-1. MISCELLANEOUS <br /> 5-1.01 PREVAILING WAGE.--Attention is directed to Section 7-1.01A(2), <br /> "Prevailing Wage," of the Standard Specifications. <br /> 5-1.0:15 OFF-SITE FABRICATION AT PERMANENT YARDS AND <br /> SHOPS:--Bidders are advised that a recent Department of Industrial relation's <br /> determination indicates Fabricators are subject to prevailing wage requirements under <br /> the following conditions: <br /> Workers employed by contractors or subcontractors are "employed in the <br /> execution of a contract for public works"when they are engaged in the off-site <br /> fabrication of items produced specially for the public works project and not for sale on <br /> the general market. <br /> Where a contractor is producing products both for its own projects and for sale <br /> on the general market, the test for whether a pre-fabricated item is specially made for <br /> the public works project turns on factors such as whether the item was produced in <br /> accordance with the plans and specifications of the architects and/or engineers for that <br /> project and/or shop drawings based thereon such that the item differs from a standard, <br /> generic item. <br /> Standard items shall be considered to be produced specially for the public works <br /> project if they were modified to meet the specific requirements of that project. <br /> For the foregoing reasons, prevailing wages must be paid to the employees of <br /> contractors and subcontractors engaged in the off-site fabrication or pre-fabrication of <br /> items specially produced for public works projects. <br /> 5-1.02 GENERAL PREVAILING WAGE RATES, EQUIPMENT RENTAL <br /> RATES, AND LABOR SURCHARGE.—The general prevailing wage rates applicable to <br /> the work to be done are on file in the Department of Public Works and with the Clerk of <br /> the Board of Supervisors. <br /> 5-1.03 INCREASED OR DECREASED QUANTITIES.--If the total pay <br /> quantity of any item of work, subject to the provisions of Section 4-1.038, "Increased or <br /> Decreased Quantities," varies more than 25 percent, compensation to the Contractor <br /> will be at contract unit prices except that an adjustment will be made in accordance with <br /> the provisions of Section 4-1.03,-"Changes,"of the Standard Specifications if,requested <br /> in writing by the Contractor or is deemed in the best interest of County by the Engineer. <br /> Written requests.byAhe Contractor shall be accompanied by adequate data to support <br /> costs of the item. <br /> 5-1 a <br /> (sPEcsNco-5-1 A) <br />
