a <br /> F. Lessor shall be responsible for providing suitable road access to <br /> the Improvements. Lessor shall also be responsible for maintaining the access road to <br /> the Improvements and otherwise keeping them clear for access. <br /> i. <br /> I <br /> G. Lessee shall construct and maintain a fence which encloses the <br /> perimeter of the Site of a height, size, material, color and type subject to the reasonable <br /> approval of Lessor. <br /> s <br /> i <br /> H. Lessee shall comply with all of Lessor's rules and requirements <br /> applicable to all persons that enter the Landfill and the Site, and shall cause its officers, <br /> directors, employees, agents, contractors and invitees to comply with all such rules and <br /> regulations when crossing Lessor's property for ingress to or egress from the Site, or <br /> when on Lessor's property for other purposes related to the transactions contemplated in <br /> this Site Lease Agreement, and shall cause its officers, directors, employees, agents, <br /> contractors and invitees to comply with all such rules and regulations. <br /> 8. TAXES AND ASSESSMENTS. Lessor shall promptly pay all taxes and <br /> assessments against the Site as and when they become due, except that Lessee shall <br /> reimburse Lessor for any increase in real estate taxes and assessments, and for any <br /> other taxes or assessments paid by Lessor which are attributable to the presence of the <br /> I <br /> Improvements on the Site as to the Lessee's occupying use of the Site. Lessor and <br /> Lessee agree that they will cooperate, at Lessee's sole cost, to request that the Site <br /> and Improvements be separately assessed. In the event such Improvements are not <br /> separately assessed, Lessee shall reimburse Lessor for the amount of the increase in <br /> taxes and assessments allocable to such Improvements. Within sixty(60) days after <br /> receipt of Lessor's statement setting out the amount due, Lessee shall have the right but <br /> not the obligation, to contest the validity of any assessment of such taxes or assessments <br /> and/or any relevant authority's failure to separately assess the Improvements, and Lessor <br /> shall reasonably cooperate with and assist Lessee. <br /> 9. DESTRUCTION OF THE PLANT. Destruction of the Plant shall be I. <br /> governed pursuant to the provisions of Article VIII (Damage or Destruction of the Plant) of <br /> the Landfill Gas Purchase Agreement. <br /> 10. WASTE PRODUCTS. Disposal by waste and condensate from Lessee <br /> shall be governed by Articles VII.F and G of the Landfill Gas Purchase Agreement. ' <br /> 11. PERMITS. Lessee shall, at its sole cost and expense, obtain all <br /> governmental approvals, permits and authorizations required for the conduct of Lessee's <br /> operations on the Site and shall maintain such permits and authorizations in effect at all <br /> times during the Term. Lessor agrees to cooperate with Lessee in making application for . <br /> and obtaining all such governmental approvals, and any and all other necessary `. <br /> approvals that may be required for Lessee's intended use of the Site. I <br /> I <br /> 12. CONDEMNATION.
