SB 2221 —4- <br /> 1 <br /> 4--1 (l) The board shall reexamine each compliance order <br /> 2 at least annually to determine whether it should remain <br /> 3 in force, should have more, less, or different conditions, <br /> 4 or should be revoked. If such a requirement is <br /> 9 imposed, the compliance order shall not be extended <br /> ld beyond the time that the countywide integrated waste <br /> 11 management plan for the count ire s <br /> 12 located shall have bee <br /> 13 (g) For the purposes r section, --compliance <br /> 14 order"means an order issued by an enforcement agency <br /> 15 and concurred in by the board, pursuant to subdivision <br /> 16 (b), for a solid waste facility which, on or before the <br /> .0 17 effective date of the act adding this chapter, is not in <br /> _ 18 compliance with the standards adopted pursuant to this <br /> r 19 division or with the terms and conditions of solid waste <br /> n 20 facility permit. <br /> 21 SEC. 2. This act is an urgency statute necessary for <br /> Y <br /> 22 the immediate preservation of the public peace, health, <br /> n 23 or safety within the meaning of Article IV of the <br /> 24 Constitution and shall go into immediate effect.The facts <br /> 25 constituting the necessity are: <br /> 26 Chapter 1095 of the Statutes of 1989 recodified <br /> 27 substantially all of the statutes relating to solid waste into <br /> 28 the Public Resources Code and prescribed a new <br /> 29 California Integrated Waste Management Board to <br /> 34 administer the new lay. That statute contained a clause <br /> 31 subordinating its repeal of provisions of Title 7.2 <br /> 32 (commencing with Section 65700) of the Government <br /> 33 Code to any other act which became effective on or <br /> © 34 before January 1, 1990. The conflicts with other <br /> 35 enactments resulted in a gap in the requirements for <br /> 36 local solid waste planning, which this act is intended to <br /> 37 correct. In order to correct those requirements at the <br /> LO <br /> CE 38 earliest possible time, it is necessary that this act take <br /> 39 effect immediately. <br /> n <br />
