PO Box 6336 Stockton, CA 95206 FINANCIAL ASSURANCES FOR INITIATING AND COMPLETING CORRECTIVE ACTIONS, FORWARD LANDFILL, SAN JOAQUIN COUNTY(CASE NO. 2209) The adoption of Waste Discharge Requirements Order No. R5-2003-0049 (WDRs) combined the former Forward and Austin Road Landfills into a single facility. This combination changes the assumptions that existing financial assurances have been based and the financial assurances need to be revised to reflect that fact. Title 27, Section 22220 requires operators of disposal facilities demonstrate the availability of financial resources to conduct corrective action activities as required under Title 27, Article 1, Subchapter 3, Chapter 3. Provision H.11. of your WDRs states as follows: The Discharger shall conduct an annual review of the financial assurances for initiating and completing corrective action and submit a report for Executive Officer review and approval. Title 27, Section 22210 requires operators of solid waste landfill to demonstrate the availability of financial resources to conduct postclosure maintenance activities. Sections 22211 and 22212 outline the Amount of Required Coverage and Post-Closure Fund Requirements respectively. Provision H.12. of your WDRs states as follows: The Discharger shall conduct an annual review of the financial assurance for closure and postclosure maintenance, and submit a report for executive officer review and approval. A complete review of the new conditions and a recalculation of financial assurances is required. Please submit a current corrective action cost estimate for review and approval by Regional Board staff that complies with Title 27, Section 22221 and demonstrations of financial responsibility for corrective actions and financial assurance for closure and post-closure respectively that comply with Title 27,by 30 May 2003.
