(2) The concentration of methane gas does not exceed the lower explosive <br /> limit for methane at the facility property boundary. <br /> THERFORE PURSUANT TO PUBLIC RESOURCES CODE DIVISION 30 AND <br /> CALIFORNIA CODE OF REGULATIONS,TITLE 27,DIVISION 7,YOU ARE <br /> HEREBY ORDERED TO: <br /> 1. Complete the installation of the gas extraction system. The gas extraction well(s) <br /> shall not be located within 100 feet of the gas monitoring probe(s). <br /> 2. Submit progress report including,but not limited to,the status of the gas <br /> extraction system,the projected completion date,the concentration of methane <br /> gas in each gas monitoring well and the compliance status to this LEA by October <br /> 25, 2003. <br /> 3. Continue routine methane monitoring program. The monitoring program shall <br /> include, but not limited to,the evaluation of the existing gas monitoring probes <br /> and the concentration of landfill gas in ambient air at ground surface. The <br /> minimum frequency of monitoring shall be quarterly. <br /> 4. Submit gas monitoring reports to this LEA in accordance with the following <br /> schedule: <br /> Monitoring Period Reporting Deadline <br /> January-March April 30 <br /> April-June July 30 <br /> July-September October 30 <br /> October-December January 30 <br /> 5. Maintain the concentration of methane gas at the boundary below the lower <br /> explosive limit(5%by volume)by December 25,2003. <br /> PLEASE TAKE FURTHER NOTICE: <br /> A. Pursuant to Section 44307 and 44310 of Public Resources Code (PRC), the <br /> owner/operator have the right to request a hearing before the Solid Waste <br /> Independent Hearing Panel in regards to this Notice and Order within 15 days of <br /> receipt of this Notice and Order. <br /> B. Failure to correct the above violation could result in a civil penalty not to exceed <br /> ten thousand dollars ($10,000) for each day the violation occurs, as cited in PRC <br /> 45023 or in the suspension or revocation of the solid waste facility permit as cited <br /> in PRC 44305 and 44306. Forward Inc. may also be subjected to a civil penalty, <br /> to be imposed administratively by the LEA, not to exceed five thousand dollars <br /> ($5,000)for each day the violation occurs, as cited in PRC 45011(a). <br /> Notice and Order 03-01 Page 3 of 5 Forward Landfill <br /> October 3,2003 <br />
